senator scott brown is trying desperately, very desperately, to fend off a challenge from democratic candidate elizabeth warren. i use the word desperate on purpose. after releasing one ad attacking elizabeth warren on the basis of race, after his staffers were caught childishly mocking native americans with the whole tomahawk chop and after the cherokee nation asked scott brown to apologize for that and he refused to do so, after all that scott brown has put out another ad today again attacking elizabeth warren on the ground of race. they must have some poll numbers showing a race based campaign is working wonders for him. it's not a whisper campaign, anonymous flyers on windshields like we used to expect. this comes straight from the campaign unapologetically. just to be clear as a bell about what the story is. it's not that scott brown has ever disproven or anybody has ever disproven that elizabeth warren has native american ancestry. it's not been disproven. it's not a lie. scott brown's whole beef with her, the whole basis for his u.s. senate campaign against her based on race i

a note a resident of district 11 mic brown has been moving around with a bus in areas where there's a low turn out and doing out research to ex fell ons eligible to vote and might not know they are eligible to vote and i want to commend mic brown for his work in the community. remember last year i had a hearing about america's cup there local business inclusion plan making sure we were hitting our stride and benefitting from america's cup events and hiring local residents in some of the temporary jobs in the staging and signs that are going up i've heard from some members of my community including members of the carpenter's local 22 and the local 510 that perhaps america's cup is not living up to its obligations around the inclusion plan so i want to have a hearing to look at the status of how we're meeting our obligations and making sure we're hiring locals so in the next couple of weeks i'll be having that hearing and i have an announcement about an important event in my district you may remember that on august 7th there was a fire that effected 8 businesses on ocean avenue and these bu

brown. this morning in afghanistan the taliban is claiming responsibility for a suicide attack that killed at least 14 people, including three nato service members. a suicide bomber riding a motorcycle rammed into a patrol. americans have a large presence there. nato is trying to sort out a weekend attack in afghanistan that left two americans dead. the casualties push the number of u.s. personnel killed in afghanistan to 2,000. the circumstances of saturday's violence remains unclear but a fire fight broke out at a checkpoint in eastern afghanistan. what nato hasn't determined so far was the gun battle a result of an insider attack or a deadly misunderstanding. drew levinson reports. >> reporter: this weekend marked the deadly milestone in afghanistan. 2,000 american soldiers killed since the war began nearly 11 years ago. it happened at a checkpoint in the eastern part of the country. one american soldier, an american contractor and three afghan soldiers were killed in a fire fight. >> the circumstances were somewhat confused but there was a report of insurgent firing taking

on a party bus. today, they are celebrating preside the fact that governor jerry brown signed the bill into law. it is called the brett studebaker law. he was three times the legal limit in 2010. the bill now requires that party bus operators ask the person making the reservation if alcohol will be served and if anyone is under 21. they also have to check identification. none of this was required on the night that brett went out to celebrate a friend's birthday. >> i feel happy that something good can come out of something so bad. >> i think it's nicely put. we feel brett's presence quite a bit. we know that brett is smiling down on this day. >> reporter: now they spoke at the family home near the tree house that brett helped his father build. the law allows penalties against the chaperon and driver and company for failing to comply. another bus in july heightened the need for all of this. if anyone underage is caught drinking, the trip is over immediately. the law takes effect in january of 2013. christie smith, nbc bay area news. >>> the east bay private eye case gets back in court t
